This legal notice includes the general terms and conditions governing access to and use of this website, which is owned by the State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service y Red.es.

Use of this website entails express and full acceptance of these general terms and conditions in the version posted at the time the user accesses the site, notwithstanding any specific terms or conditions that may apply to some of the specific content or services on the website.

For the purposes of this document the “reusing agent” means any individual or legal entity that reuses public sector information, whether for commercial or non-commercial purposes.

Obligatory nature of general terms and conditions.

These general terms and conditions, permanently available under datos.gob.es/en/legal-notice, shall be binding upon any reusing agent for the mere fact of making use of the documents subject to them.

Authorisation for reuse and non-exclusive assignment of intellectual property rights.

These general terms and conditions permit reuse of the documents subject to them for commercial and non-commercial purposes. Reuse means the use of documents held in the possession of the agencies of the Public Administration and other national public sector bodies and entities referred to in Article 1.2 of Royal Decree 1495/2011, of 24 October, by which develops the Law 37/2007, of 16 November, on reuse ofpublic sector information state, by individuals or legal entities for commercialor non-commercial purposes, whenever such use does not constitute a public administrative activity. For example, authorised reuse may include activities such as copying, disseminating, modifying, adapting, extracting, reordering and combining information.

The definition of document is as established in the Appendix to Law 37/2007, of 16 November, on the reuse of public sector information, which includes any information regardless of the physical or electronic medium in which it is stored, or whether it is expressed in figures, sound or images, therefore including data in its most disaggregated form or “raw data”.

This authorisation also covers the free, non-exclusive assignment of the intellectual property rights, if applicable, to such documents, authorising the reproduction, distribution, broadcasting or transformation activities necessary to undertake the authorised reuse activity, by any method and in any format, worldwide and for the maximum term permitted by the Law.

Terms of reuse.

The following general terms and conditions apply to the reuse of the documents subject thereto:

  1. Distortion of the meaning of the information is prohibited.
  2. The source of the documents being reused must be cited. It may be cited as follows: “Source: State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service​”.
  3. The date of the last updating of the documents being reused must be cited whenever it is included on the original document.
  4. It cannot be indicated, insinuated or suggested that the State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service which owns the reused information participates, sponsors or supports the reuse of the information concerned.
  5. The applicable metadata on the date of updating and the terms of reuse included, if applicable, in the document made available for reuse must be kept on file and not altered or deleted.

Liability disclaimer.

Data sets shall be used by the users or reuse agents at their own expense and risk, and they shall be exclusively liable to third parties for any damages that may arise therefrom.

The State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service hall accept no liability for the use made of its information by the agents reusing it nor for any damages or financial, material or data losses arising directly or indirectly from the use of the reused information.

The State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service does not guarantee the indefinite availability of the content and form of the reusable documents, and accepts no liability for any error or omission in them.

Responsibility of the reusing agent.

The reusing agent is subject to the regulations applicable to the reuse of public sector information, including the penalty system set forth in Article 11 of Law 37/2007, dated 16 November, on the reuse of public sector information.

Personal data protection.

The Public Corporate Entity Red.es is committed to complying with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as indicated in the following link: Personal Data Protection.

Modifications.

In order to improve the features of the website, the State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service reserves the right, at any time and without prior notification to the user, to modify, expand, or temporarily suspend the presentation, configuration, technical specifications and services of the website unilaterally.

The hyperlinks contained on the website may direct users to third party websites. The State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service assumes no liability for the content, information or services appearing on these sites, which are provided for information purposes only and under no circumstances represent any relationship between the State Secretariats for Public Administrations and Telecommunications and the Information Society and the individuals or entities responsible for such content or for the sites where the content is located.

Multilingual version.

This website has been translated into the different official languages of Spain in their respective territories, in accordance with Article 3 of the Spanish Constitution of 1978 and its Statues of Autonomy. These languages are Catalan, Euskera and Gallego. It has also been translated into a foreign language, English.

The website content has been translated to different levels. This includes translations of the navigation menus, static texts, and content where the origin and frequency of updating mean it is suitable for translation.

Please note that at times the version in Castilian Spanish may be more recent than the other languages and discrepancies may arise due to the time needed for the translation process.
