Authorisation for reuse and non-exclusive assignment of intellectual property rights.
These general terms and conditions permit reuse of the documents subject to them for commercial and non-commercial purposes. Reuse means the use of documents held in the possession of the agencies of the Public Administration and other national public sector bodies and entities referred to in Article 1.2 of Royal Decree 1495/2011, of 24 October, by which develops the Law 37/2007, of 16 November, on reuse ofpublic sector information state, by individuals or legal entities for commercialor non-commercial purposes, whenever such use does not constitute a public administrative activity. For example, authorised reuse may include activities such as copying, disseminating, modifying, adapting, extracting, reordering and combining information.
The definition of document is as established in the Appendix to Law 37/2007, of 16 November, on the reuse of public sector information, which includes any information regardless of the physical or electronic medium in which it is stored, or whether it is expressed in figures, sound or images, therefore including data in its most disaggregated form or “raw data”.
This authorisation also covers the free, non-exclusive assignment of the intellectual property rights, if applicable, to such documents, authorising the reproduction, distribution, broadcasting or transformation activities necessary to undertake the authorised reuse activity, by any method and in any format, worldwide and for the maximum term permitted by the Law.
Terms of reuse.
The following general terms and conditions apply to the reuse of the documents subject thereto:
Distortion of the meaning of the information is prohibited.
The source of the documents being reused must be cited. It may be cited as follows: “Source: State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service”.
The date of the last updating of the documents being reused must be cited whenever it is included on the original document.
It cannot be indicated, insinuated or suggested that the State Secretariat for Digitalisation and Artificial Intelligence of the Ministry for Digital Transformation and Public Service which owns the reused information participates, sponsors or supports the reuse of the information concerned.

Responsibility of the reusing agent.
The reusing agent is subject to the regulations applicable to the reuse of public sector information, including the penalty system set forth in Article 11 of Law 37/2007, dated 16 November, on the reuse of public sector information.

What we do
Datos.gob.es was launched in 2011 with the aim of promoting the opening of public information and the development of advanced services based on data. It was promoted by the Ministry for Digital Transformation and Public Service through the public company Red.es.
The platform was developed within the framework of the Aporta Initiative, undertaken in response to the legislative framework introduced. It is divided into seven lines of action (see below) that are reflected on datos.gob.es. The platform is presented as a meeting point between public administrations, companies and citizens, all forming part of the data ecosystem in Spain.
The Aporta Initiative, a key element in the Spanish government’s data policy, has the principal objective of harmonizing and taking efficient advantage of synergies between data projects already up and running. The aim is to promote and coordinate the actions being developed by the different levels of the administration, the private sector and academia at all times, in line with an integrated governance model. All this is undertaken in order to promote new products and services form the private sector and civil society for the benefit of society.

Raising awareness
The awareness actions are geared towards incentivising the opening up of quality data and fostering their reuse for the development of advanced data-driven services.
The objectives are the following:
To foster the interaction between stakeholders of open data ecosystem, at both national and international level.
To raise awareness on the value of public data and their reuse, especially in sector where data-driven innovation is key element.
To encourage publishers and reusers to improve practices to ensure the success of data-driven activities.
To identify and disseminate the business models or reuser companies, success stories, etc. in order to foster the extrapolation of successful practices.
To value the efforts of civil servants in making available the data generated in the course of their activity.
Position datos.gob.es as an exemplary leader in the dissemination of knowledge on aspects related to the data economy and reuse of public data.
To reach these objectives, a number of actions are developed:
The datos.gob.es platform publishes latest news, news around innovation with data, outstanding projects of reuser companies, reference guides and reports linked to new trends and challenges in the world of data.
Participation in meetings, conferences and panels, organised by both the datos.gob.es team and other entities.
Organisation of awareness and training sessions, both internally and in collaboration with other institutions.
Dissemination of domestic and international data-related news and developments, through social media profiles on LinkedIn, X (@datosgob) and Instagram (datosgob).

Analysis and statistics
The datos.gob.es team carry out constant monitoring of the activity carried out with open data in Spain, sharing information through different channels:
We participate in international questionnaires and studies that provide an overview of the state of openness and reuse of public data in Spain.
The Map of open data initiatives in Spain allows us to consult active initiatives, their characteristics and access respective web spaces.
The Catalogue of Applications and a Catalogue of Companies are maintained up to date with examples of data-driven solutions and services, reflecting the diversity and dynamism of the sector.
In collaboration with the National Observatory of Telecommunications and the Information Society (ONTSI), companies that reuse public sector data, whether as their principal activity or a specific business line, are analysed.
National cooperation
Cooperation at national level is essential for achieving a greater impact and cohesion in policies for opening and reusing public data. To achieve this:
Work is carried out with Autonomous Communities and local entities through established mechanisms like sector-specific conferences and working groups.
Informal cooperation groups are created to promote the reuse of public information based on the common interests of the public and private sector.
Bilateral agreements are signed with key entities, with results integrated on datos.gob.es.
Collaboration with the private sector is boosted through consultative working groups, geared towards maximising the impact of opening data.
International cooperation
As part of its international cooperation work, the datos.gob.es team looks to contribute with its experience in the definition of international policies and strategies. Within this scope:

In this regard, the datos.gob.es team offers its contributions to national and international regulatory proposals aimed at facilitating the access to quality public data, prioritzing those of high value.
